The domestic waste collection and transportation agency project is one of the essential administrations of local governments. However, compared to its importance, the system is lagging, and the management and supervision are sloppy. As a result, controversy over budget waste and opaque company selection continues in some regions.

This project ranks high among local governments' general account expenditures, but when bidding, evaluation criteria favorable to a specific company are applied or the evaluation criteria are often formally operated. Suspicions of bid rigging and collusion with politicians have already been raised in several regions. After all, this structure is operating in a structure close to 'protection of vested rights' rather than 'fair competition'.

Paju City's attempt is noteworthy in this regard. Paju City has eased standards for permitting domestic waste agency businesses for the first time in the country and introduced competitive bidding, saving about 7 billion won in budget with just one improvement. On the contrary, Pyeongtaek City has been criticized for its lack of administrative power, revealing the loopholes of the system intact. The same administrative area, different results. The key is will and competence.

As Choi In-hye, director of the Korea Institute of Autonomy and Law, pointed out, objective and practical evaluation criteria should be introduced, and the existing performance-oriented additional point system should be reorganized. Laws and institutions should be applied flexibly, but principles should be applied clearly. It is time to clarify the legal distinction between consignment and agency.

Above all, the monitoring function of local councils is important. When local politics turn a blind eye to the problem of life politics, the irrational structure repeats. It is a fortunate change that some local councils, including Gangseo-gu, Seoul, have recently begun to officially deal with this issue.

Meanwhile, Gumi City's revision of the urban planning ordinance to prevent indiscriminate disturbance of resource circulation-related facilities is a new approach to the domestic waste problem. System design that considers both the environment and settlement conditions becomes the starting point for protecting the quality of life of citizens.

Now we can't help but ask. Who is the administration for domestic waste agency? Citizens or specific companies. Before this question, local governments must answer. Unless transparency and fairness are right, this project will inevitably become a "budget black hole."

생활폐기물 수집·운반 대행 사업은 지방자치단체의 필수 행정 중 하나다. 그러나 그 중요성에 비해 제도는 낙후되어 있고, 관리·감독은 허술하기 짝이 없다. 그 결과, 일부 지역에선 예산 낭비와 불투명한 업체 선정 논란이 끊이지 않는다.

사업 구조를 들여다보면 문제의 본질이 보인다. 이 사업은 지자체 일반회계 지출 항목 중 상위를 차지하지만, 입찰 시에는 특정 업체에 유리한 평가 기준이 적용되거나, 심사 기준이 형식적으로 운용되는 경우가 많다. 입찰 담합, 정치권과의 유착 의혹은 이미 여러 지역에서 제기된 바 있다. 결국 이 구조는 ‘공정한 경쟁’이 아닌 ‘기득권 보호’에 가까운 구도로 작동하고 있는 셈이다.

그런 점에서 파주시의 시도는 주목할 만하다. 파주시는 생활폐기물 대행업 허가 기준을 전국 최초로 완화하고 경쟁입찰을 도입해, 단 한 번의 개선으로 약 70억 원의 예산을 절감했다. 반대로 평택시는 행정력 부족으로 비판을 받으며 제도의 허점을 그대로 드러냈다. 같은 행정 영역, 다른 결과다. 핵심은 의지와 역량이다.

최인혜 한국자치법규연구소 소장이 지적했듯, 객관적이고 실질적인 평가 기준을 도입하고, 기존 실적 중심의 가점 체계를 재구성해야 한다. 법과 제도는 유연하게, 그러나 원칙은 분명하게 적용되어야 한다. 위탁과 대행의 법적 구분도 이제는 명확히 해야 할 시점이다.

무엇보다도, 지방의회의 감시 기능이 중요하다. 지역정치가 생활정치의 문제를 외면하면, 불합리한 구조는 반복된다. 최근 서울 강서구를 비롯한 일부 지방의회에서 이 문제를 정식으로 다루기 시작한 것은 그나마 다행스러운 변화다.

한편, 구미시가 자원순환 관련 시설의 무분별한 난립을 막기 위해 도시계획 조례를 개정한 것도 생활 폐기물 문제의 새로운 접근이다. 환경과 정주 여건을 함께 고려한 제도 설계는, 결국 시민의 삶의 질을 지키는 출발점이 된다.

이제는 묻지 않을 수 없다. 생활폐기물 대행 행정은 누구를 위한 것인가. 시민인가, 특정 업체인가. 이 질문 앞에, 지자체는 답해야 한다. 투명성과 공정성이 바로 서지 않는 한, 이 사업은 ‘예산 블랙홀’이 될 수밖에 없다.
